You can read full document <a href=\"http:\/\/hikeandbike.si\/wp-content\/uploads\/2021\/05\/hike-and-bike-terms-and-privacy.pdf\" target=\"_blank\" data-type=\"attachment\" data-id=\"1654\" rel=\"noreferrer noopener\">here<\/a>.<\/p>\n\n<p><strong>General obligations of Turisticna agencija HIKEANDBIKE, Gregor \u0160ilc s.p. and Maja \u0160ilc s.p. or Hike&amp;Bike Slovenia (HBS) for activities, accommodation and packages &amp; deals<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>We expect participants to be reasonably mentally and physically fit, not under influence of alcohol or any other drugs or medicines.<\/li>\n\n\n\n<li>We have the right to cancel the tour if the number of participants is less than the minimum.<\/li>\n\n\n\n<li>HBS advises against participation in activities to pregnant women, persons with serious health problems or injuries.<\/li>\n\n\n\n<li>HBS reserves the right to cancel or drop the activity in the case of bad weather or other circumstances. If HBS cancels the trip you are entitled to full refund of your reservation.<\/li>\n\n\n\n<li>We do not grant refunds in case the trip duration was reduced due to the participants lack of physical condition.<\/li>\n\n\n\n<li>Sport activity lasts from the starting point of the tour (when the participant meets with the guide) and ends when he arrives at the finish point of the tour. HBS takes no responsibility for injuries, occurred outside the course of the trip.<\/li>\n\n\n\n<li>HBS takes no responsibility for injuries, caused in opposition to these general obligations or in the case the participant neglects to follow the guide`s instructions.<\/li>\n\n\n\n<li>Persons with asthma or with other health problems, must inform the guide or the authorized employee of the HBS before the start of the activity.<\/li>\n\n\n\n<li>Any injury that happens during the trip, should be reported immediately to the guide or the authorized employee of HBS. HBS will not consider injuries, reported at a later stage.<\/li>\n\n\n\n<li>HBS takes digital photos of participants during the trip and therefore reserves the right to use the photos for internal and promotional purposes. Photos made by HBS are property of HBS.<\/li>\n\n\n\n<li>HBS takes no responsibility for lost, stolen or damaged personal items.<\/li>\n\n\n\n<li>Reservations can be made by phone and\/or e-mail.<\/li>\n\n\n\n<li>A deposit of 30% of the total invoice must be completed to confirm a reservation.<\/li>\n\n\n\n<li>If participants without prior notice do not appear, they are not entitled to any refund.<\/li>\n\n\n\n<li>Prices are in euro and per person. Prices include VAT. HBS reserves the right to change prices without warning.<\/li>\n\n\n\n<li>HBS reserves the right to change the general obligations at any time and in any manner for any reason and without warning.<\/li>\n\n\n\n<li>Personal data protection: All personal data of our participants are used and saved strictly<br\/>in accordance to law \u2013 Zakon o varstvu osebnih podatkov (Ur. l. RS, \u0161t. 94\/2007-UPB-1, ZVOP-1).<\/li>\n<\/ul>\n\n<p>RESERVATIONS<\/p>\n\n<p>All reservations must be made in written form by email. By confirming a reservation, the customer confirms that he\/she is aware of the Terms and Conditions of HBS and fully comprehends and accepts these terms.<\/p>\n\n<p>To guarantee the reservation a 30% deposit is required. For bookings made within 14 days of arrival, full payment is required. The customer is obligated to provide any information required for the reservation process.<\/p>\n\n<p>BOOKING CONFIRMATION<\/p>\n\n<p>Upon receiving a booking, we will send you written confirmation. With written confirmation we guarantee all services as per our program.<\/p>\n\n<p>PAYMENT<\/p>\n\n<p>A 30 % deposit is required at booking. The remaining 70% must be received at least 14 days before arrival. HBS has the right to cancel a reservation in case the payment has not been received within the agreed terms. Payment can be made via bank transfer.<\/p>\n\n<p>CLIENT OBLIGATIONS<\/p>\n\n<p>All HBS clients must have valid travel documentation. Respect and abide by all customs and foreign exchange regulations of the destination country. Respect and abide by all customs and foreign exchange regulations as well as the laws and other regulations of the Republic of Slovenia as well as other countries through which he\/she passes through or resides in.<\/p>\n\n<p>Inquire whether or not he\/she requires a visa for the destination country as well as neighboring countries. In the event the client is unable to continue the trip as a result of being in direct violation of these regulations, the traveler is responsible for all related expenses.<\/p>\n\n<p>Abide by the house rules of the accommodation unit as well as cooperate with the service provider in a well \u2013 intentioned manner. Present the service provider in the document proving paid service (voucher received via e-mail or fax).<\/p>\n\n<p>TRAVEL INSURANCE<\/p>\n\n<p>HBS advise guests to arrange travel insurance covering the costs of accidents or death, treatment of illnesses, transport home and loss or damage of luggage and similar.<\/p>\n\n<p>OFFERS<\/p>\n\n<p>HBS ensures services according to the information published and valid at the time of the confirmation of reservation, and according to the description and travel period in accordance with confirmed reservations except in circumstances beyond HBS\u2019s control such as illness of the service provider or his\/her immediate family, outstanding circumstances which cannot be foreseen nor eliminated (natural disasters such as earthquakes, floods, sanitary disruptions, fires, droughts, wars, strike, terrorist actions and limitations issued by the government mobilization, country exit ban).<\/p>\n\n<p>RESERVATION CHANGES<\/p>\n\n<p>Every change in the reservation has to be previously confirmed and agreed with HBS.<\/p>\n\n<p>CANCELLATIONS<\/p>\n\n<p>In the event the client wishes to change or cancel a confirmed reservation he\/she must do so in writing (via e-mail). Changes or cancellations by telephone are not permitted and will not be accepted. In the event that the client should request to make a change or cancel a confirmed reservation, the date on which the written cancellation is received, during regular HBS\u2019s working hours, will represent the basis for the cost calculation. If the written cancellation is received outside regular HBS\u2019s working hours, the cancellation date which will represent the ground for calculating cancellation costs will be the following working day of HBS.<\/p>\n\n<p>The cancellation charges will be calculated as follows:<\/p>\n\n<p>More than 30 days before arrival date, 10% of the total amount, but not less than 20 \u20ac<\/p>\n\n<p>29-21 days before arrival date, 20% of the total amount<\/p>\n\n<p>20-14 days before arrival date, 30% of the total amount<\/p>\n\n<p>13-10 days before arrival date, 50% of the total amount<\/p>\n\n<p>9-4 days before arrival date, 80% of the total amount<\/p>\n\n<p>3-0 days before arrival date, 100% of the total amount<\/p>\n\n<p>In the case of no-show, all reserved services will be charged.<\/p>\n\n<p>COMPLAINTS<\/p>\n\n<p>Each customer \u2013 reservation holder has a right to file a complaint if the paid services were not provided. If the services provided are not satisfactory, the customer is required to immediately notify HBS about the inadequate service and file a complaint on the day of his\/her arrival at the location of the service provider and to inform HBS by email at <a href=\"mailto:grega@hikeandbike.si\">grega@hikeandbike.si<\/a> or <a href=\"mailto:maja@hikeandbike.si\">maja@hikeandbike.si<\/a> or by phone at +386 31 374 660 or +386 31 353 845 (customer service working hours). The customer is obligated to cooperate with HBS\u2019s representative as well as with the service provider in a well-intentioned manner so that the cause of the complaint can be resolved.<\/p>\n\n<p>If upon arrival the customer is not satisfied with the state of the accommodation and leaves the accommodation on his own initiative and finds another accommodation without giving HBS a chance to resolve the issue, correct the cause of the discontent, or find other accommodation for the client, the client does not have a right to request a refund or make a claim for compensation, regardless of the fact that his\/her reasons were justified or not.<\/p>\n\n<p>The client should accept the proposed solution which corresponds with the service rendered on the spot, HBS will not take additional complaints into consideration or respond to them.<\/p>\n\n<p>If the problem is not resolved on the spot following an intervention, the client is obligated to submit a written complaint along with supporting documents as well as any photographs to support the complaint to the agency by email at <a href=\"mailto:grega@hikeandbike.si\">grega@hikeandbike.si<\/a> or <a href=\"mailto:maja@hikeandbike.si\">maja@hikeandbike.si<\/a> not later than 60 days following the return of the client from his\/her trip. HBS shall only take into consideration fully documented complaints which are received within the 60-day deadline.<\/p>\n\n<p>HBS is obligated to make a written solution to the complaint within 8 days of receipt of the written complaint. HBS can postpone the deadline in order to collect the evidence and check the claim quotes with the service provider but not for more than 8 days. HBS will take into consideration only those claims whose cause could not be resolved on the spot.<\/p>\n\n<p>HBS can not be held responsible for climate conditions, nor for other similar situations and events which can result in the dissatisfaction of clients and are not a direct result of the accommodation unit or activity provided (for example, bad weather, improperly maintained beaches, crowds, lost or stolen property and such).<\/p>\n\n<p>If the customer decides to book the special LAST MINUTE deal, then he accepts all risks of such travel. These journeys include the uncertainty of the facts upon which the agency can not influence, and the customer primarily due to the price accepted such a trip and therefore has no right of complaint to the agency.<\/p>\n\n<p>RIGHT TO CHANGES AND CANCELLATIONS<\/p>\n\n<p>HBS reserves the right to make changes of reservations in the event of circumstances which cannot be predicted, avoided or eliminated. A reserved accommodation unit can only be changed with prior notification to the traveler for an accommodation unit of the same category or of a higher category and at the price at which the client confirmed the reservation. If the replacement accommodation is only possible in a higher-category unit where the price is 15% higher than the price of the paid reservation, HBS reserves the right to charge the client for the difference in agreement with the client. In the event a replacement accommodation unit cannot be arranged, HBS reserves the right to cancel the reservation and notify the client prior to the beginning of the service and guarantee a full refund of the paid amount. If HBS cancels a reservation, the traveler is not entitled to any compensation from HBS and HBS is only obligated to refund the amount paid to HBS\u2019s account. If an adequate replacement unit is not available on the day of the commencement of the service, HBS will make an effort to provide the client with information on possible alternative arrangements.<\/p>\n\n<p><strong>Varstvo osebnih podatkov<\/strong><\/p>\n\n<p>Turisti\u010dna agencija HIKEANDBIKE, Gregor \u0160ilc s.p. in podjetje Maja \u0160ilc s.p., s kratico HBS, Stara Fu\u017eina 117, 4265 Bohinjsko jezero, elektronski naslov grega@hikeandbike.si, je upravljavec z osebnimi podatki.<\/p>\n\n<p>HBS se zavezuje, da bo posredovane osebne podatke varovala v skladu z Zakonom o varstvu osebnih podatkov (ZVOP-1). Vsi posredovani podatki bodo obravnavani strogo zaupno in za namen, zaradi katerega so bili posredovani.<\/p>\n\n<p>Osebne podatke posameznika HBS obdeluje in jih hrani za dosego namena, zaradi katerega jih je posameznik posredoval: komunikacijo preko obrazca za povpra\u0161evanje do preklica privolitve.<\/p>\n\n<p>Pri obravnavi posredno in neposredno posredovanih podatkov nas obvezuje Zakon o varstvu osebnih podatkov, s katerim se dolo\u010dajo pravice, obveznosti, na\u010dela in ukrepi, s katerimi se prepre\u010dujejo neustavni, nezakoniti in neupravi\u010deni posegi v zasebnost in dostojanstvo posameznika oziroma posameznice pri obdelavi osebnih podatkov. Podlago za zbiranje osebnih podatkov predstavlja kontaktni obrazec, na katerega oseba zapi\u0161e svoje ime, priimek in e-po\u0161tni naslov.<\/p>\n\n<p>HBS se obvezuje, da podatkov ne bo posredovala tretjim osebam, prav tako ne izven EU, EGP in mednarodnim organizacijam tega prostora, razen kadar je to v skladu z veljavno zakonodajo. V \u010dasu upravljanja z osebnimi podatki ima posameznik pravico vpogleda, prepisa, kopiranja, dopolnitve, popravkov, blokiranja in izbrisa osebnih podatkov v zbirki podatkov, skladno z veljavno zakonodajo.<\/p>\n\n<p>HBS bo pridobljene podatke varovala ter prepre\u010devala njihovo zlorabo. Osebni podatki bodo uporabljeni le za namene, za katere je uporabnik dal svoje soglasje. HBS se zavezuje, da bo zbrane podatke hranila le toliko \u010dasa, kolikor bo nujno potrebno za dosego namena, zaradi katerega so bili zbrani. Po prenehanju potrebe po vodenju osebnih podatkov oz. na podlagi pisnega preklica uporabnika (na e-naslov grega@hikeandbike.si) se podatki izbri\u0161ejo oziroma se uni\u010dijo nosilci podatkov.<\/p>\n\n<p>Uporabniki imajo kadarkoli pravico \u200b<strong>zahtevati spremembo oziroma izbris svojih osebnih podatkov <\/strong>\u200bpreko e-naslov grega@hikeandbike.si. Podatki bodo izbrisani v najkraj\u0161em mo\u017enem \u010dasu.<\/p>\n\n<p><strong>Zloraba podatkov<\/strong><\/p>\n\n<p>Zavezujemo se, da bomo varovali va\u0161e osebne podatke v skladu z GPDR. V kolikor bi pri\u0161lo do zlorabe podatkov, vas bomo o tem obvestili na va\u0161 e-po\u0161tni naslov v najkraj\u0161em mo\u017enem \u010dasu, vendar ne kasneje kot v 72 urah od ugotovitve zlorabe.<\/p>\n\n<p><strong>Odgovornost<\/strong><\/p>\n\n<p>Spletna stran je postavljena in vzdr\u017eevana z najve\u010djo mo\u017eno mero skrbnosti. Kljub temu HBS ne jam\u010di za a\u017eurnost, to\u010dnost ali pravilnost vseh informacij na strani. Vse informacije se lahko spremenijo brez predhodnega obvestila.<\/p>\n\n<p><strong>Pi\u0161kotki<\/strong><\/p>\n\n<p>Pi\u0161kotki so majhne datoteke z informacijami, ki se za\u010dasno shranijo na va\u0161 ra\u010dunalnik. Ko se pi\u0161kotki namestijo na va\u0161 ra\u010dunalnik, o tem niste obve\u0161\u010deni. Glavni namen pi\u0161kotkov je, da spletni stre\u017eniki prepoznajo va\u0161 ra\u010dunalnik in spletni brskalnik, prilagodijo spletno stran ter poskrbijo za enostavnost in hitrost. Pi\u0161kotki nam omogo\u010dijo, da vam prika\u017eemo pravilne informacije, ki jih i\u0161\u010dete in vas zanimajo. Z zbiranjem in pomnjenjem informacij o va\u0161ih nastavitvah spletnega mesta s pomo\u010djo pi\u0161kotkov lahko zagotovimo bolj\u0161o spletno stran in tr\u017eenjske izku\u0161nje. Pi\u0161kotki nam ne dajejo dostopa do ra\u010dunalnika in podatki, ki jih zbiramo preko pi\u0161kotkov, ne vklju\u010dujejo osebnih podatkov.<\/p>\n\n<h2 class=\"wp-block-heading\">Kaj so pi\u0161kotki?<\/h2>\n\n<p>Pi\u0161kotki so majhne tekstovne datoteke, v katerih brskalnik (Chrome, Edge, Firefox itd.) shranjuje podatke za pomo\u010d prikaza in delovanja spletnih strani.<\/p>\n\n<p>Nekateri pi\u0161kotki so nujni za delovanje in varnost spletnih strani, drugi pa slu\u017eijo kot pomo\u010d za izbolj\u0161anje uporabni\u0161ke izku\u0161nje, zbiranje statistike obiskanosti spletne strani in podobno.<\/p>\n\n<h2 class=\"wp-block-heading\">Obvezni pi\u0161kotki<\/h2>\n\n<p>Obvezni pi\u0161kotki so nujni za nemoteno delovanje spletnih strani in ne zbirajo nobenih osebnih informacij.
